Rockers On Trial: Defense Attorney Paul Biegler
Makes a Case For Rock History's Greatest Screams!

Your honor, ladies and gentlemen of the jury...

Rock music screamers have been getting a bad rep
and a bad rap, and today they are on trial here in this
courtroom. Submitted for your approval...or disapproval
as the case may be - Exhibit A - Maria Brink and her
rock/metal band In This Moment. Click at the
3:11 mark of the video and listen for
17 seconds... until 3:28.

"Her Kiss" - In This Moment
from Sept. 2008 album The Dream)

 (START PLAYING AT 3:11 MARK
AND LISTEN TO 3:28)

People who judge "Her Kiss" solely on the basis of the
crunching guitars and screaming vocals in that portion
of the song are getting a distorted impression
of the recording and the artist. Those who
listen from start to finish enjoy quite
a beautiful love song.

Now I'm just a humble country lawyer trying to
do the best I can against this brilliant prosecutor
from the big city of Lansing, but I intend to prove
beyond shadow of a doubt that screaming
in popular music is nothing new.

You see, as a lawyer, I've had to learn that rock
isn't just good or just bad. Rock is many things.

Oh... now... now it's true that the kids listen to it
and play it too loud and it gives us old folks a
headache and so forth... but... but...

...well, if it please the court, I would like to submit
Exhibit B. Click at the 4:36 mark of the following
video and you will experience Janis Joplin, a
Screaming Mimi whose shouting vocal style
made her The First Lady of Rock - loved
by millions - 40 years before Maria
Brink appeared on the scene.

"Ball 'n' Chain" - Janis Joplin
(Live at Monterey Pop, June 1967)

(START PLAYING AT 4:36 MARK!)

Listen now to Exhibit C - "Won't Get Fooled Again,"
a hit by The Who that made Rolling Stone's list
of The 500 Greatest Songs of All Time.
Click at the 7:45 point on the video
and you'll hear one of the greatest
primal screams in rock history!

"Won't Get Fooled Again" - The Who
(Summer season 1971)

(START PLAYING AT 7:45 MARK!)

Exhibit D is "Whole Lotta Love" by the much loved
British blues rock/heavy metal band Led Zeppelin.
Listen at the 4:19 point of the song and you
will hear another epic rock scream!

"Whole Lotta Love" - Led Zeppelin
(November 1969)

(START PLAYING AT 4:19 MARK!)

Now here's Exhibit E, something the younger generation
calls a mash-up. It combines "Whole Lotta Love"
with another classic rock song, "Helter Skelter,"
by the Beatles, the world's most popular band.
The Beatles often shouted and screamed their
vocals and I never heard anybody complain
about them... except my mommy!

"Whole Lotta Helter Skelter"
Soundog Mix - The Beatles vs. Led Zeppelin
(November 1968/November 1969)

Now listen, this is a cross examination in a rock music
discrimination case, not a high-school debate!

What are you and Dancer trying to do, railroad
Miss Brink into the Clink? Hey, that rhymes!

Your honor, the prostitution prosecution would have us
believe that screaming in modern rock is more dark,
dangerous and evil than it was in the 1960s.

Well that's like trying to take the core from an apple
without breaking the skin. (Did that argument make
any sense at all?) I beg the court... I beg the court
to let me cut into the apple... because we've
been at this all morning and I'm hungry.

Exhibit F is "Lost Someone" by the Godfather of Soul,
James Brown. An early 60s ballad, "Lost Someone" is
nevertheless peppered with passionate screams from
Mr. Brown and from the audience. Please click at the
55 second mark of the song for indisputable proof!

"Lost Someone" - James Brown
(Live at the Apollo, October 1962)

(START PLAYING AT 55 SEC. MARK!)

In summation, screaming has been an integral part of
popular music for more than 60 years. Think about it.
Nobody raised a fuss when mainstream superstars
like The Beatles and James Brown screamed.

It is our contention that all screamers are created equal.
Moreover we believe it is a crime to condemn modern
rockers who practice the same age old technique that
their beloved predecessors used. The defense rests
with one last assertion, your honor. At its best,
rock is a scream and we ask...we, we beseech
the good citizens of the blogging community
to give it a fair chance.

I tend to agree, Mr. Biegler.

There's no reason to make
a federal case out of it.

Happy anniversary to
one of my favorite movies...

    1. Hi, Arleen!

Thank you for swinging by, dear friend, and for being the early bird this week!

It's good to know that the screaming of Janis Joplin is still music to your ears. Just think. It has been more than 52 years since Joplin sang "Ball 'n' Chain" at Monterey Pop and stunned the audience which included, as you see in that clip, Mama Cass Elliot.

I'm delighted to help get you awake with some of the greatest screams in rock history. Thanks again for coming and have a wonderful week, dear friend Arleen!

    1. Hi, Alex!

Arleen beat you to the punch and claimed early bird honors this time, but I nevertheless welcome you to Shady's Place and thank you for coming!

Screams, shouts, Cookie Monster death growls... it's all good in my book. Rock just isn't the same, isn't genuine rock, without them.

Thanks again for dropping in, good buddy Alex, and enjoy your week!

  3. Tom,

Your posts always make me smile. I have not seen this old Jimmy Stewart film but I do enjoy his work. I'll have to see if I can find it now. I loved how you tied a court room plea for mewsic screamers. Very clever. You're so right, screamers in mewsic mind you have been around a long time. I don't like mewsic that screams but I do like the fun vocalization in spots of songs, especially when its unexpected which translates as an artists' being totally caught up hish/her song. I'm glad to the judge ruled in favor with defense in this case. :) Have a great week, my freind!

    1. Hi, Cathy!

Thanks for coming, dear friend! I'm delighted to have you here as I pay tribute to one of my favorite old films, the 1959 courtroom drama Anatomy of a Murder, 60 years after it made its worldwide debut in a Michigan theater. (The movie is set in Michigan's upper peninsula.)

I am also happy you agree that screaming has its place in popular mewsic, even if it isn't your favorite means of artistic expression. I keep coming back to Maria Brink because she's my favorite Screaming Mimi.

Thank you again for stopping by during your summer hiatus, dear friend Cathy. Have a safe and happy week exploring your scenic region with DH!

    1. Hi, Kelly!

How are you, dear friend? Thanks for coming by to experience some of the greatest primal screams in rock history! Heavy metal scream queen Maria Brink is the defendant in this case. Over the years Maria has been the target of attacks whenever I post ITM songs. I think she's in capable hands with Paul Biegler as her defense lawyer. I trust his persuasive argument will convince metal haters that screaming on record is nothing new. It is a time honored practice in rock music.

I'm thrilled that you like Led Zep, The Who and James Brown. Thanks for letting me know. How about that custom made mashup song and video "Whole Lotta Helter Skelter"? Cool, isn't it?

Thanks again for being here, dear friend Kelly, and enjoy the rest of your week!

  5. Yes, screamers have been around for a long time, but some of today's screamers are pretty annoying! It's more of an eerie grunting growl, than a passionately painful scream, as in the James Brown song, "Lost Someone". This is one of my James Brown favorites, his screaming makes sense-you can feel the emotions, and see how James draws the audience in to his pain! (I rest my case)

Another favorite, Shady and "Your Honor", Janis Joplin-"Ball and Chain". Try as I might, I could never come close to imitating her moaning and screaming parts in the song. This is a unique trait of Janis' that only she could conjure up! Thanks for presenting this one, counselor!

"Don't Get Fooled Again" is probably a household tune by now. What a scream!
How do they do it? This song will get your blood gushing through your veins in a 'heartbeat' so to speak! I think all ages have probably heard this one at some point, and at least on TV! I can remember when Scootie didn't realize that it is an actual song by a popular band. As a tyke, he would look up from his play phone or truck to see where the scream was coming from. I love hearing it when it is used on TV-what a group!

I've seen "Anatomy of A Murder" several times, and would watch it again, because sometimes I need a refresher on the story line, and characters (but don't tell anyone) Haha! It's hard to imagine it was 60 years ago!

Well, Shady...I guess I could give it a chance, with the volume down low! I just feel that today's screamers aren't as dramatic and believable as in the 60's and 70's. It's like they have no control over the screams.

I hope you are doing well, Shady! Thank you for the great post featuring some of the best bands ever! I like the "Whole Lotta Love/Helter Skelter" video, it was fun to see the two groups performing together and simultaneously.

Have a great week, dear Shady! Stay cool-Yes...I'm talking to you!

    1. Hi, Suzanne!

Thanks so much for dropping in dear friend! I'm excited to see you here and to know that you have watched Anatomy of the Murder several times over the years. So have I! The star-studded film remains one of my all time favorites of any genre. George C. Scott's reaction is priceless there at the end of the trial when Jimmy Stewart and his witness pull a big surprise on him. And how about Eve Arden from the TV series Our Miss Brooks in the role of Biegler's legal secretary?

Well, it looks like you are one of those people who needs a little more convincing about the defendant in this case, Maria Brink. She remains my favorite of all current rock artists and I think she stacks up against some of the best in rock history, especially in terms of live performance stage showmanship. I am glad to know that you enjoyed the other acts in my rock show including brother James Brown live at the Apollo, Janis Joplin at Monterey Pop in June 1967 and The Who in the studio doing one of their hit singles and a very long song-- "Wont Get Fooled Again." First, did you notice the cut-aways of Mama Cass in the audience at Monterey looking mystified by Joplin's incendiary performance? Those reax shots of Cass with her jaw dropping are great moments in rock history. Second, as I am sure you know, that Who scream from "Won't Get Fooled Again" marks the starting point of the opening theme of the hit TV crime series CSI: Miami. if you were or are a regular viewer of that show, it would explain why Scootie is familiar with the scream and the song.

It's hard to keep my cool in this steam bath we call Florida in the summertime, and that's why I am hunkered down in the air conditioning. Are you having a sizzling summer so far?

Thanks again for joining the fun, dear friend Suzanne. Take care and have a super week!

    2. I don't know if I have a favorite 'current' rock artist. I do like some of them, as I try to keep up with new stuff. I did listen to Maria Brink's song, and agree that it is beautiful-lovely vocals and music, but of course, I didn't get the scream.

And, I have seen the Janis video, and watched it again here, since you graciously included it. I recognized Mama Cass and she appears to be fascinated just as I was. I need to get a fresh copy of the CD that has this one, since I am sure my cassette tape is so obsolete, haha!

Don't you know I was, and still am a fan of CSI Miami. My sister and I just love the show, and I get a couple of episodes Friday nights on the More TV channel right before Chicago PD! Scootie would always look up when the beginning song came on, with big eyes and his little mouth rounded, haha!

Take care, Shady! I'm staying inside too!

    3. Hi, again, Suzanne!

Truth be told, I prefer the harmonious, melodic, sunshine pop and folk rock style of The Mamas and the Papas over that of Janis Joplin. I didn't buy Joplin's records and didn't understand what all the fuss what about. I liked Jimi Hendrix much more, and I like screamer Maria and her band In This Moment most of all. I'm happy to know you enjoy watching Horatio Caine and the gang on CSI: Miami, a hit series that lasted 10 seasons and 232 episodes. David Caruso also appeared in the detective vs gangster drama Crime Story playing a rather unsavory character. I can't get Mrs. Shady interested in watching Chicago P.D., and therefore I might need to watch it by myself.

Thanks again for coming over to chat, dear friend Suzanne! :)

  6. Shady, Shady, Shady, a blog after my own heart. I love all of these songs; Led Zeppelin, the Who, and Janis Joplin have been staples in my life since I was a teenager. "Whole Lotta Love" and "We Won't Get Fooled Again" are some of my favourites. I'm glad the lawyer came around. :)

I first learned of In This Moment through you back in 2016. I've fallen in love with the group and I am just amazed with the sound. Christina said they are interesting live; she thought they were meh live. I would love to see them live.

    1. Hi, Jessica Marie!

Thanks for sitting in on the Trial of the Century as Paul Biegler defends Maria Brink's right to scream! I have been saving this post for three or more years, since I was still publishing on SDMM, and the 60th anniversary of Anatomy finally rolled around.

I'm delighted to find a fan of hard rock who doesn't need any arm twisting to appreciate this style of music, but then again I already knew you like this type of stuff. I'm glad you appreciated my scream specimens by Zep, The Who, Janis and ITM. I don't know when your friend Christina saw ITM live, but they rocked harder in years past than they do now. Their latest album is tame compared to previous albums which contained the hard stuff upon which they built their reputation and fan base.

Thanks again for reporting in, dear friend JM, and enjoy the rest of your week!

    3. Hi, Jessica Marie!

Two years ago, In This Moment was on a North American tour as a band in transition. They had been rocking hard for years but their new album Ritual would mark a change in direction. Wiki says: << The set list was compiled from Blood and Black Widow while also debuting three songs from the band's upcoming sixth album, Ritual, including the first single "Oh Lord", and a cover of Phil Collins "In the Air Tonight". Ritual was released on July 21, 2017 and said to have a more serious tone. >>

I don't like Ritual as much as other ITM albums. I don't know anything about Christina's taste, but I'm saying I hope the band goes harder and heavier on their next album which is reportedly soon to be released.

      Happy I-Day, dear friend JM!

  7. Hi Tom,
I really enjoyed your clever post today! I love how you used a Jimmy Stewart courtroom film to make your case. I'm a big Jimmy Stewart fan. Fabulous film stills too! I'm sure I saw this movie but right this second I can't say for sure. I have to say that I fall on the prosecutor's side of this argument, much to your dismay I'm sure.
I love the iconic rock screams your submitted. Love the Who's scream, Led Zeppelin's scream, James Brown's scream and (most of the time) Janis Joplin's screams. Is that because those songs are part of my life's soundtrack and evoke my beloved days gone by? Perhaps. Although, I have to admit: there are times when I can't handle a Joplin scream. I have to be in the right mood for it at this stage of my life.
I do feel though that the today's heavy metal/death metal screams are far less appealing TO ME than those of yesteryear. They're different. They're almost sinister and they make my head explode. Maybe I'm just too old for today's screamers...

But this sure was a fun post. And I really dug the Beatles/Led Zeppelin "Whole Lotta Helter Skelter" mashup. That was very cool. And the video was fantastic.

You put on a good case, my friend. I'm just one person on the jury so will look forward to hearing how this case's verdict lands. Keep me posted.

    1. Hi, Michele!

I am very happy to see you, dear friend. How's is going? Thank you for coming!

Mrs. Shady and I highly recommend Otto Preminger's Academy Award nominated 1959 courtroom drama Anatomy of Murder. The film is well written and boasts great acting performances by major stars of the period. It is also laced with humor which I find highly appealing in a dramatic movie or TV series.

I agree with your observation. You, like everyone else, are anchored to songs that were part of the soundtrack of your life, particularly recordings that were familiar in your youth. Older recordings and newer ones are foreign to your ears and tend to be an acquired taste. In the 21st century I avoided extreme metal like the plague until one day in 2012 a switch flipped in my mind and suddenly it spoke to me, reached me, inspired and empowered me, and In This Moment became my favorite band of the genre. In the metalcore genre "sinister" is a good thing. It's part of the act. It's funny, but Janis Joplin's style has always irritated me, but I could listen to and watch Maria Brink all day every day, and I am years older than you.

I'm happy to know you appreciated the mashup video "Whole Lotta Helter Skelter." I discovered it on YouTube three years ago and have been patiently waiting for the 60th anniversary of Anatomy to come around so that I could include it in this post.

All it takes is one juror, and Paul Biegler's got Jessica Marie in his pocket. Looks like we might have a hung jury in the trial of scream queen Maria Brink. :)

Thank you again, very much, for coming out to play, Michele. I hope life is getting a little more manageable for you these days. I hope things are returning to normal and that your heart is on the mend following your latest agonizing loss. I think about you every day and send best wishes for better days ahead. Bless you, dear friend Michele, and take good care of yourself!

Thanks for joining the party, good buddy! I'm pleased to know you are already familiar with Anatomy of a Murder and that you love the film same as I do. I didn't know that important piece of trivia about Joseph Welch who appeared as the judge. Thanks for letting us know. However, now I must ask you the following question: "At long last, have you left no sense of decency?" :) Sadly, Welch died of a heart attack a little more than a year after the release of Anatomy. Just think, Kirk. That old guy, Judge Weaver, was younger than I am now when the film was produced. It is very hard for me to wrap my mind around such facts.

I'm glad you appreciate what I did here. Thanks again for coming, good buddy Kirk, and enjoy the rest of your week!

I'm happy to see that I got two comments for the price of one from you again this time, dear friend. Thanks for coming by! I figured the production stills of Jimmy Stewart as Paul Biegler in Anatomy of a Murder would catch your eye. I know, BB. You have told me more than once that, for some reason, you still haven't watched Anatomy. You really should. Along with Jimmy Stewart, the courtroom drama features Geo. C. Scott, Ben Gazarra, Lee Remick, Arthur O'Connell, Eve Arden, Kathryn Grant, Orson Bean, Murray Hamilton, Duke Ellington and more.

You made me LOL by telling me what happened when you played Janis Joplin's scream segment within earshot of your hubby and his aunt. If they thought she sounded like birds, I wonder what they thought Maria Brink sounded like - a buzzsaw? :)

Thanks again for joining the fun on my last two posts, dear friend BB. Enjoy your visit in Quebec and safe travels home!

Thanks for coming all the way down from Canada, dear friend. I'm excited to see you!

I'm pleased that you were picked from the jury pool, sworn in, seated, and listened as lawyer Paul Biegler made his case for screaming in rock music, with ITM's lead zinger Maria Brink as the notorious poster girl. May I assume that "thumps down" is the same thing as "thumbs down"? :) So far most jurors are voting "guilty" as you did in Maria's trial, but there's one hold out - Jessica Marie - and the defense is counting on her clinging to her "not guilty" decision to avoid a conviction. Seems like you enjoyed some of the other scream queens and kings in the post. I'm glad!

She was one performer that when you heard her and saw her on stage (I was lucky enough to see her when she appeared at Santa Clara University) you couldn't help but be excited. Yet as she sipped from her whisky bottle and sang "Freedom's just another word for nothing left to lose," you knew this girl was on a fast, but very short track. Thanks for the music as always.

I'm delighted to see you, dear friend. Happy 4th of July and thank you for coming to visit!

I'm so glad you shared the story of seeing Janis Joplin live at Santa Clara University. What a thrill it must have been to witness her boozy/bluesy interpretation of "Me And Bobby McGee," a cover song that shot to #1 when it was released posthumously as a single following her death. Of the artists in this post, the only one I saw live was James Brown who appeared at the York Interstate Fair and later at Penn State.

Keep those musical memories fresh in your mind and replay them often, dear friend Cheryl-Lee. Thanks again for dropping by. Have a safe and happy holiday and enjoy the month of July!

What you're thinking
There are some things you can't hide
I wanna know
What you're feeling
Tell me what's on your mind
